Purchase Agreement and Limited Warranty

PURCHASER ACKNOWLEDGES AND UNDERSTANDS THAT JIB BOX IS A THEFT DETERRENT DEVICE. JIB LOCK BOX, LLC CANNOT AND DOES NOT GUARANTEE AGAINST THEFT OR SPOILAGE OF ANY ITEM CONTAINED WITHIN THE JIB BOX. ANY SECURITY DEVICE CAN BE COMPROMISED WITH THE CORRECT TOOLS AND TIME, INCLUDING THE JIB BOX. 

THEREFORE, JIB LOCK BOX, LLC ONLY WARRANTS REPLACEMENT OF THE JIB BOX IF IT IS DEFECTIVE. SPECIFICALLY EXCLUDED FROM THE WARRANTY ARE ANY ITEMS CONTAINED WITHIN THE JIB BOX AND ANY DIRECT, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES.  

PURCHASER UNDERSTANDS AND AGREES THAT JIB LOCK BOX, LLC IS NOT RESPONSIBLE FOR ANY DAMAGES, EXPENSES, OR LOSS DUE TO LOSS OR SPOILAGE OF ANY ITEMS CONTAINED WITHIN THE JIB BOX.

Warranty
JIB Lock Box, LLC (“Company”)  warrants that JIB Box devices and accessories ("Products") are free from defects in material and workmanship under normal use and service. The warranty period commences upon the date of purchase by the first consumer purchaser and continuing for a period of one year. This is a warranty of replacement and repair only, whereby JIB Lock Box, LLC will correct defects in material and/or workmanship without charge.

This Limited Warranty is conditioned upon proper use of the Product.

This Limited Warranty does not cover: (a) defects or damage resulting from accident, misuse, abnormal use, abnormal conditions, improper storage, neglect, or unusual physical, electrical or electromechanical stress; (b) scratches, dents and cosmetic damage, unless caused by JIB Lock Box, LLC; (c) defects or damage resulting from excessive force; (d) product that has the identification number removed, defaced, damaged, altered or made illegible; (e) ordinary wear and tear; (f) defects or damage resulting from the use of Product in conjunction or connection with accessories, products, or ancillary/peripheral equipment not provided by JIB Lock Box, LLC; (g) defects or damage resulting from improper testing, operation, maintenance, installation, service, or adjustment not provided by JIB Lock Box, LLC, including but not limited to installation of unauthorized software and unauthorized root access, both of which shall void this limited warranty; (h) defects or damage resulting from external causes such as collision with an object, fire, flooding, dirt, windstorm, lightning, earthquake, exposure to weather conditions, theft, disruption of electricity, or improper use of any electrical source; (i) defects or damage resulting from cellular signal reception or transmission, or viruses or other software problems introduced into the Product;

To obtain service under this Limited Warranty, you must give notice to JIB Lock Box, LLC within thirty (30) days of the date of discovery of the defect and return the Product to an authorized service facility in an adequate container for shipping, accompanied by the sales receipt or comparable proof of sale indicating the original date of purchase by the first consumer purchaser. To obtain assistance on where to deliver the Product, please call JIB Lock Box, LLC Customer Service at 888-424-0369 or email customerservice@jibbox.com. If JIB Lock Box, LLC determines that any Product is not covered by this Limited Warranty, you must pay all parts, shipping, and labor charges for the repair or return of such Product.

You should keep a separate backup copy of the settings or codes of the Product before delivering the Product to JIB Lock Box, LLC for warranty service, as some or all of the settings or contents may be deleted or reformatted during the course of warranty service.

In no event shall JIB Lock Box, LLC be liable for consequential or incidental damages resulting from the use, installation, performance or failure of its products or any of the hardware contained in or on its products. This express limited warranty is exclusive and in lieu of any other warranties of JIB Lock Box, LLC, with respect to replacement and/or repair of any table, accessory or hardware. All warranties implied by law, including the implied warranties of merchantability and fitness for a particular purpose, are expressly waived and disclaimed.

Shipment and Delivery of Product
The Company is not responsible for damage to Product which occurs in transit or in storage.  It is the purchaser's responsibility to examine goods upon receipt and to file any claims with the carrier.  Any claims against the Company for apparent defects, errors, or shortages must be made by the purchaser by emailing customerservice@jibbox.com within seven (7) working days after any delivery.  Failure by the purchaser to make any claim against the Company within seven (7) days shall constitute acceptance of the goods and a waiver of any apparent defects, errors, or shortages.

The shipping date specified by Company represents the Company's best estimate of an approximate shipping date at the time of order acknowledgement.  However, the Company shall not incur any obligation or liability to purchaser for failure to ship by any particular date. In addition, in no event shall the Company be liable for any loss or damage resulting from any delay or failure in shipment or other failure to perform all or any part of the agreement between the parties with respect to Product where such delay, failure, loss, or damage is the proximate result of any act of any governmental authority or political subdivision thereof, revolution, riot, civil disorder or disturbance, act of enemies, delay or default in transportation, strike, disputes among or between labor unions or other labor disputes, delay or inability in obtaining materials and facilities, fire, flood, act of God, or any cause not within the reasonable control of the Company, whether of the class of causes enumerated or otherwise.  Without limiting the generality of the foregoing, the Company may, without causing any breach or incurring liability, allocate goods which are in short supply, irrespective of the reasons therefore, among purchasers in any manner which the Company in its sole discretion deems advisable.

Returns
All merchandise returned to JIB Lock Box, LLC must be initiated within 30 days of original delivery/purchase and require JIB Lock Box, LLC approval before return. If you are encountering a problem, please contact Customer Service at email customerservice@jibbox.com before initiating a return so we can help solve your problem. All returns must be boxed and shipped as they were originally received including foam and other packing materials, so as not to be damaged in transit.

Additionally, all keys and other accessories must be included in the return shipment. Damage to boxes or product may result in loss of credit for the product. 

For returns due to reasons other than JIB Lock Box, LLC error, the customer is responsible for return freight, please insure the shipment, and a 25% restocking fee will be charged. Special orders or custom products are not returnable for credit.

To initiate a return, please send an email including your name, ship to address, sales order number, and reason for return to customerservice@jibbox.com.

Installation
If customer requests JIB Lock Box, LLC, or its contractors, to install the JIB Box, customer agrees that JIB Box is not responsible for any damage either as a result of, or consequential to, the installation. Customer acknowledges that installation may include drilling and attaching the box to a porch or building which may result in permanent defacing of the structure. Customer also acknowledges that installation of the smart JIB Lock may require access to your internet server or home controller and agrees that JIB Box is not responsible for any damage either as a result of, or consequential to, that access.

Applicable taxes
Purchaser is responsible for all applicable taxes including sales, use, local and state taxes. JIB Lock Box, LLC will apply applicable taxes to the sales transaction as it is able, however purchaser is ultimately responsible for ensuring all taxes are paid.

Privacy Policy
JIB Lock Box, LLC values your privacy. We strive to maintain the minimum amount of your personal information that still allows us to properly service your account. Information we store and keep are:

1.     Name
2.     Address
3.     Phone number
4.     Email address
5.     JIB Lock Box, LLC products you have purchased or requested information
6.     A record and summary of any communication you have had with JIB Lock Box, LLC (ex: emails, text messages, phone conversations, etc.)

We use this information for our JIB Box product marketing and product service updates.  We will communicate new products and offers to you utilizing the information stored. We will also utilize the information stored to update you with any product updates or improvements. If you wish to opt out of these communications, please communicate this to us via email to customerservice@jibbox.com.  

We do not sell or share your information with organizations outside of JIB Lock Box, LLC. We do not collect or store any credit card or on-line payment information.  These payments are processed by a reputable 3rd party processor that specializes in on-line transactions.

Disputes
All disputes with JIB Lock Box, LLC arising in any way from this Purchase Agreement and Limited Warranty or the sale condition or performance of the products shall be resolved exclusively through final and binding arbitration, and not by a court or jury. Any such dispute shall not be combined or consolidated with a dispute involving any other person’s or entity’s product or claim, and specifically, without limitation of the foregoing, shall not under any circumstances proceed as part of a class action. The arbitration shall be conducted before a single arbitrator whose award may not exceed, in form or amount, the relief allowed by the applicable law. The arbitration shall be conducted according to the American Arbitration Association (AAA) Commercial Arbitration Rules applicable to consumer disputes. The AAA Rules are available online at adr.org or by calling the AAA at 1-800-778-7879. This arbitration provision is entered pursuant to the Federal Arbitration Act. The laws of the State of Michigan, without reference to its choice of laws principles, shall govern the interpretation of the Purchase Agreement and Limited Warranty and all disputes that are subject to this arbitration provision. The arbitrator shall decide all issues of interpretation and application of this arbitration provision and the Purchase Agreement and Limited Warranty.
